Terms of Service

These terms govern your use of FarmRecord, a service operated by FarmRecord Ltd (company no. SC892495)("we", "us"), whose registered office is at 1 Quay Street, Port Bannatyne, PA20 0NL. By creating an account or using the service, you agree to these terms. If you're agreeing on behalf of a business, you confirm you're authorised to do so.
1. What FarmRecord does
FarmRecord is a tool for recording and organising farm-compliance information — spray, fertiliser and livestock-medicine records, certificates, reminders and audit packs — so you can keep your records in one place and produce them when asked.
2. Your responsibility for compliance
FarmRecord is a record-keeping tool, not regulatory, legal or agronomic advice. It helps you keep and present your records, but it does not check, certify or guarantee that you meet the requirements of Red Tractor or any other assurance scheme, the rules on the use of pesticides or veterinary medicines, or any other law or regulation.
You remain solely responsible for the accuracy and completeness of the information you enter, for following the correct on-farm practices, and for meeting your own legal and assurance obligations. We are not responsible for the outcome of any audit or inspection, for lost or refused certification, or for any fine or penalty.
3. Your account
You're responsible for keeping your login details secure and for everything done under your account. Tell us promptly if you think someone else has gained access. You agree to give accurate account information and to keep it up to date.
4. Free trial
New accounts include a free trial (currently 14 days) with no card required. At the end of the trial you'll need to choose a paid plan to keep adding records and generating audit packs. Records you've already created remain yours.
5. Subscriptions, billing and renewals
- Plans and prices are shown on the billing page, in pounds sterling; any applicable taxes are shown before you pay.
- Paid plans renew automatically — monthly or yearly, depending on the plan you choose — until you cancel.
- You can cancel at any time from the billing portal. Your plan stays active until the end of the period you've paid for, and we don't charge you again after that.
- We don't generally refund part-used periods, but if something has gone wrong, email us and we'll try to put it right.
- If a payment fails, we may limit or suspend access until it's resolved.
- If we change our prices, we'll give you reasonable notice before your next renewal.
6. Your data and content
Your records and uploaded documents are yours — we don't claim ownership of them. We process them only to provide the service, as described in our Privacy Policy. You can export your records at any time, including before deletion if you cancel. You're responsible for having the right to store any third-party information you enter (for example, a client farm's details).
7. Acceptable use
You agree not to misuse the service — including not breaking the law, not attempting to disrupt or gain unauthorised access to the service, not uploading harmful or unlawful content, and not reselling or providing the service to others without our written permission.
8. Availability
We work to keep FarmRecordavailable and reliable, but we provide it "as is" and can't guarantee it will always be uninterrupted or error-free. We may occasionally need to suspend it for maintenance or updates.
9. Limitation of liability
Nothing in these terms limits liability that can't be limited by law (such as for death or personal injury caused by negligence, or for fraud).
Subject to that, we are not liable for indirect or consequential losses, for loss of profit, business or data, or for any fine, penalty or loss of certification arising from your use of — or inability to use — the service. Our total liability to you in any 12-month period is limited to the amount you paid us for the service in that period. FarmRecord is a business service, so some consumer protections may not apply.
10. Suspension and termination
You can stop using the service and close your account at any time. We may suspend or end your access if you breach these terms or use the service in a way that risks harm to us or others. We'll give notice where it's reasonable to do so.
11. Changes to these terms
We may update these terms from time to time. We'll update the date at the top, and we'll tell you about significant changes in the app or by email. Continuing to use the service after a change means you accept the updated terms.
12. Governing law
These terms are governed by the law of Scotland, and the courts of Scotland will have exclusive jurisdiction, except where the law gives you the right to bring a claim elsewhere.
